Collaborative law

Collaborative law

This is an amicable way of trying to resolve issues arising from a divorce or separation or even to try to agree the terms of a Living Together Agreement or Pre-nuptial agreement. The aim of collaborative law is to try to resolve matters without the need for court proceedings. The Collaborative Law process involves you and the other person with whom the issues needs to be resolved, your Family Solicitor and their Family Lawyer working as a team, all agreeing to be open and honest and all aiming to reach an agreement through meetings with everyone present, so matters can be discussed face to face. Both lawyers will be on hand to help you both try to reach an agreement.

A participation is signed by everyone to show their commitment to the process, the agreement also means that if the issues cannot be resolved and then court proceedings are needed you will both have to instruct new Lawyers from different law firms. This sometimes is seen a negative but it does mean that everyone will then try to strive to reach an agreement to avoid you both having to get new legal representation.
